Terms of service

Last updated: 3 November 2026

1. Provider and scope

1.1stay’in is provided by Meik Schütz, NIF 231101538, Rua Parque Norte, 23, 2.1, 4600-105 Braga, Portugal ("we", "us"). Contact: hello@stayin.pt.

1.2These terms govern access to and use of stay’in by anyone who creates an account in the admin area (admin.stayin.pt). The data processing agreement forms part of them. By creating an account you accept both; if you do not agree, do not use the service.

1.3The terms are available on this page in a form you can save and print, as Decree-Law 7/2004 on electronic commerce requires.

2. Definitions

2.1In these terms, the following expressions have the meaning given.

ExpressionMeaning
"Host" or "you"Whoever creates the account and runs the accommodation, including the people they invite to the account.
"Account"The access to the admin area created at admin.stayin.pt.
"Alojamento"One alojamento local establishment with its own registration (RNAL), with all the listings that belong to it.
"Service"stay’in: the admin area, the guest pages, the direct booking site and the features described on the features page.
"Subscription"The paid plan, yearly or monthly, that gives access to the Service after the trial.
"Content"The data you enter or that reaches your Account: bookings, guests, messages, invoices, expenses and documents.
"Consumer"A natural person who contracts outside their trade, business or profession (Law 24/96 and Decree-Law 24/2014).

3. The account

3.1The Account is for people who run alojamento local as part of their professional or business activity. You must be at least 18.

3.2The details you give must be true, complete and kept up to date. Keep your password safe and tell us at once, at hello@stayin.pt, if you suspect someone else has access.

3.3You are responsible for what is done in the Account, including by the people you invite to it.

3.4We may suspend or close an Account created with false details or used in breach of these terms.

4. The service

4.1stay’in is software for running an alojamento local: it reads bookings from the platforms' calendars and emails, takes direct bookings on your own booking site, prepares the SIBA reports, tourist tax, VAT and Modelo 30, and gives each guest a page with the details of their stay.

4.2The available features are described on the features page. We may improve them, change them or add new ones. If we withdraw an essential feature, we give at least 30 days' notice by email, unless the change is needed for security or to comply with the law, in which case it may take effect immediately.

4.3Features marked beta are being tested and may change or fail.

4.4We aim to keep the Service available at all times, but do not guarantee it. There may be interruptions for maintenance or because of faults; when they are planned, we try to warn you first.

5. Trial, price and payment

5.1The first 30 days are free, with every feature and no card.

5.2To continue after that, add a payment method. The price is the one published on the pricing page: currently €99 a year or €12 a month, with 1 alojamento included, and €50 a year or €5 a month for each extra alojamento. VAT is added at the legal rate.

5.3The Subscription is paid yearly or monthly, depending on the plan chosen, at the start of each period of service, and renews automatically for the same period. We issue an invoice for every payment.

5.4Payment is collected through a payment service provider. That provider's terms also apply to the transaction.

5.5If we change the price, we give at least 30 days' notice by email. The new price applies from the period after that notice; if you do not agree, you can cancel before then.

5.6If you do not add a payment method by the end of the trial, or a payment fails and is not settled, the Account becomes read-only and its data is deleted 30 days later.

6. Cancellation and termination

6.1You can cancel at any time by writing to hello@stayin.pt. Cancellation takes effect at the end of the period already paid, a month or a year, and you keep access until then; partial periods are not refunded, except as the consumer section provides.

6.2We can end the contract with at least 60 days' notice by email. In that case we refund the part already paid for the period without service.

6.3We can suspend or close the Account immediately, without notice, if it is used unlawfully or in serious breach of these terms, or if continuing the Service becomes unlawful. No compensation is due in those cases, without prejudice to Consumers' rights.

6.4When the contract ends, for whatever reason, your right to use the Service ends. Your data is handled as the "Your data" section describes.

7. Your legal obligations

7.1stay’in prepares returns and reports, but does not submit them for you and does not give tax or legal advice. The accommodation's obligations — the RNAL registration, registering guests with SIBA, tourist tax, VAT, Modelo 30, invoicing — remain yours.

7.2Check the figures before you submit them. The calculations rest on the data in the Account; a missing booking or a wrong amount changes the result.

7.3The guides on the website are general information, not advice.

8. Your data

8.1The Content is yours. For guests' data and other people's, you are the controller and we process it on your behalf, under the data processing agreement, the General Data Protection Regulation and Law 58/2019. Your Account data is handled as the privacy policy describes.

8.2You must have a legal basis for the data you enter and for connecting your accounts and mailboxes to stay’in. You are responsible for the accuracy and lawfulness of the Content.

8.3On request, we give you a copy of your data in a commonly used format. When the Account ends, we delete your data within 30 days, except what the law requires us to keep.

9. Third-party services

9.1stay’in depends on services we do not control: Airbnb, Booking.com, your mailbox, SIBA and others. If one of them changes, fails or stops allowing access, the matching feature may stop working. Your use of those services remains subject to their own terms.

10. Artificial intelligence

10.1Some features use artificial intelligence: suggested replies, reading invoices and receipts, translations. The result can be wrong; review it before you use it. No suggestion is sent to a guest unless you send it.

10.2These features may have monthly usage limits.

11. Acceptable use

11.1You may use the Service only for lawful purposes and in line with these terms.

11.2You may not:

  • process guests' or properties' data without a legal basis, in particular outside the alojamento local regime (Decree-Law 128/2014);
  • try to reach other Accounts' data or any part of the Service without authorisation, or get around its security;
  • upload Content that is unlawful, defamatory, fraudulent or infringes others' rights;
  • reverse engineer, decompile or try to extract the Service's code;
  • deliberately overload or disrupt the Service;
  • resell or pass on access without our written agreement.

12. Intellectual property

12.1The Service — the software, the design, the documentation and the stay’in brand — is ours or licensed to us. These terms transfer no rights in it to you.

12.2For the term of the contract, we grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service to run your own alojamentos.

12.3The Content remains yours. You grant us only the right to process it as far as needed to provide the Service to you.

13. Liability

13.1We are liable without limit for damage caused intentionally or through gross negligence, for death or personal injury, and in any other case where the law does not allow liability to be limited.

13.2In all other cases, our total liability is limited to the amount you paid us in the 12 months before the event that gives rise to it, and we are not liable for lost profits, loss of business or indirect damage.

13.3We are not liable for fines, interest or other consequences of returns or reports you submitted without checking them, nor for decisions taken using the Service in place of legal, tax or accounting advice.

13.4If a figure is wrong because of a calculation error on our side, we fix it as soon as possible and help you prepare the replacement return.

13.5This section does not affect the rights the law gives Consumers.

14. If you contract as a consumer

14.1stay’in is meant for people who run alojamento local as an economic activity. If you nonetheless contract as a Consumer, this section also applies to you, and nothing in these terms removes the rights the law gives you, including those under Law 24/96 and Decree-Law 83/2021.

14.2Right of withdrawal: you may withdraw from the Subscription contract, without giving a reason, within 14 days of its start, by writing to hello@stayin.pt (Decree-Law 24/2014). As the Service starts immediately at your request, we deduct from the refund the part proportional to the period already provided; the rest is returned within 14 days, by the same payment method. In your message, state:

  • that you withdraw from the stay’in subscription contract;
  • the account email and the subscription start date;
  • your name, your address and the date.

14.3Conformity: during the Subscription, the Service must conform to the contract (Decree-Law 83/2021). If it does not, we put it right free of charge and within a reasonable time; if that is not possible, you are entitled to a proportional price reduction or to terminate the contract.

15. Complaints

15.1You can make a complaint by email to hello@stayin.pt. We acknowledge it within 5 working days and answer within 15 working days.

15.2If you are a Consumer and we do not settle the complaint between us, you may turn to a consumer alternative dispute resolution body (Law 144/2015), such as CNIACC, the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (cniacc.pt); the full list is at consumidor.gov.pt. You may also use the electronic complaints book (livroreclamacoes.pt). Using these bodies is voluntary and does not remove your access to the courts.

16. Changes to these terms

16.1If we change these terms materially, we give at least 30 days' notice by email, or with a notice in the admin area. If you do not agree, you can cancel before the change takes effect; continuing to use the Service after that date counts as acceptance.

16.2The date at the top of this page identifies the version in force.

17. Governing law and jurisdiction

17.1These terms are governed by Portuguese law.

17.2Disputes with Hosts who contract in the course of their business go to the court of the Braga district, the provider's seat. A Consumer may turn to the court of their own domicile.

18. Final provisions

18.1If any clause of these terms is invalid, the rest remain in force.

18.2These terms, the data processing agreement and the privacy policy form the entire agreement between us about the Service and replace any earlier agreement.

18.3If we do not enforce a clause on one occasion, that does not mean we waive the right to enforce it on another.

18.4You may not assign your position in this contract without our written agreement. We may assign it to a successor of our business, telling you by email.

18.5The terms exist in Portuguese and English; if they differ, the Portuguese version prevails.
